Sparky and Shady Terms and Policies

1. Definitions

1.1 We, us, our, mean Kathryn Sheehan Individual/Sole Trader ABN 66 354 523 422 of 5 Harbour Drive, Coffs Harbour, NSW, phone 0409 711 608 trading as Sparky and Shady, and our employees.

1.2 You and your mean the purchaser of goods or the participant of services, which together include; books, ebooks, online courses, online subscriptions, workshops and all other content purchasable from us. These will be referred to as products.

1.3 By using the website payment gateway and/or by making a direct debit payment as a purchaser or participant of products, you are indicating that you have read and that you understand and agree to be bound by Sparky and Shady Terms and Policies.

1.4 This is a contract between us and you.

2. Terms

2.1 When you purchase products from us, we grant you a licence (which is non-transferable) to read, listen to, download (limited to PDFs) or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise download, copy, reproduce, distribute or use the content other than as set out in this contract. You must not share your login and password, sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom.

2.2 We may terminate your license to use any purchased products if you breach this contract.

3. Payment

3.1 Payment is requested and due in full at the time of purchase of a product.

3.2 Delivery of physical products will be arranged within 24 hours of a purchase but may take between 3 and 7 working days for postal orders to arrive via postal services.

3.3 Delivery of non-physical products including online services, will be as stated on the workshop event or online event as listed on the website.

3.4 On completion of payment and delivery of a product or the service being provided to you a completion email will be sent to you.

3.5 You may request to make payment by instalments via regular direct debit or online gateway payments. If you and we agree that you may make payments by instalments, you must pay all instalments on or before each due date. The due date for the first instalment is at the time of purchase and then weekly after each previous instalment until the agreed upon amount is paid in full.

3.6 All products sold by us are charged in AUD dollars. If you are located in Australia your GST payment is covered by us, that is, we will cover the 10% GST in the price of the product. If you reside outside Australia, you will pay the price of the product as indicated on the website.

4.Warranty, Refund, Money Back and Guarantee Policy

4.1 Warranty: We will repair, replace or refund at our discretion any physical goods which are physically defective for the period of 12 months after purchase. This warranty does not apply to defects which occur because of misuse or accidental damage.

4.2 Refund: If you cannot attend a workshop or event due to personal, family or health issues, you are covered by this policy as follows:

Up to 24 hours before the workshop or event. If you report a personal, family or health issue up to 24 hours before the workshop or event, we agree, at your discretion, to either (i) reimburse you 100% of the workshop or event cost (either paid by you through the website booking page or direct debit payment/s), or (ii) give you a credit to the same value as the amount you paid for a future workshop or event.

Less than 24 hours before the workshop or event. If you report a personal, family or health issue less than 24 hours before the event, we agree, at your discretion, to either (i) reimburse you 75% of the workshop or event cost (either paid by you through the website booking page or direct debit payment/s), or (ii) give you a credit to the same value as the amount you paid for a future workshop or event, including online courses.

No show. If you do not notify us that you will not be attending the live workshop or live event,  (i) no refund will be given, (ii) and no future credit will be given.

4.3 Subscription: For subscription services you may cancel at any time and no further fees will be deducted from your account.

4.4 Money Back Guarantee: If you attend a workshop, event, buy an online course or a subscription to an online course, including live streaming, and you are not satisfied with the content, presenter or circumstances, you may request a full refund under the following circumstances:

(a) you must be the participant that attended the workshop or event, including the live stream;

(b) you must make your request to us in writing within 24 hours of the workshop or event, including the first live stream finishing, explaining the exact nature of your dissatisfaction; and

(c) you must not have directly or indirectly caused the dissatisfaction (through your action, omission or negligence).

(d) If you receive your money back you must delete every copy of the product that you have downloaded as well as copies you have placed on other devices or media.

4.5 Australian Consumer Law. You may be entitled to a refund as a result of your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

5. Privacy: By purchasing products from the website we agree to respect your privacy as follows.

5.1 Email policy. If you correspond with us through email, or provide your email to join our subscribers list, we may retain the content of your email messages together with your email address and our responses. Your email address will be kept confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties. We will maintain the information you send via email in accordance with applicable federal law. In addition, all email messages will contain clear information on how to remove yourself from our mailing list so that you receive no further email communication from us.

5.2 Personal details. When you purchase a good or participate in a service your personal details including; name, email, address, phone number, child details, aspiration for your child (or children) and credit card details will be collected on registration forms or through our payment gateway. These details will not be disclosed to any third parties and are only collected for the purposes of providing and delivering the goods or service requested.

5.3 Credit card transactions. Your credit card transactions are processed securely, and no card details are stored after the completion of a sale of a product.

We will respond to any complaint within 10 business days of the date of receipt. We will attempt to resolve your complaint to your satisfaction. If you are not satisfied with how we deal with your complaint you may contact the Australian Information Commissioner, whose contact details can be found at http://www.oaic.gov.au/
