1. Definitions

1.1 We, us, our, mean Kathryn Sheehan Individual/Sole Trader ABN 66 354 523 422 of 5 Harbour Drive, Coffs Harbour, NSW, trading as Sparky and Shady, and our employees.

1.2 You and your mean the purchaser of goods or the participant of services, which together include: online course memberships and related digital content purchasable from us. These will be referred to as products.

1.3 By using the website payment gateway and/or by making a direct debit payment as a purchaser or participant of products, you indicate that you have read, understood, and agree to be bound by Sparky and Shady Terms and Conditions.

1.4 This is a contract between us and you.

2. Terms

2.1 When you purchase products from us, we grant you a licence (non-transferable) to access, read, download and watch such content solely for your personal, non-commercial use. You agree not to otherwise download, copy, reproduce, distribute, or use the content other than as set out in this contract. You must not share your login and password, sell, transfer, lease, modify, distribute, or publicly perform the content in any manner, and you must not exploit it commercially. Specifically, you must not on sell memberships if you have received an educator product with coupon codes for free access to the families product. 

2.2 When you purchase an educator product, you will receive between 1 and 80 free ‘Families’ online course coupon codes for the families of the children in your care after your role as an educator in a centre or school has been verified. The verification process will be deemed approved if an educator email matches the place of employment and/or the nominated centre or school confirm your employment and their approval to use the resource on site. 

2.3 If you purchase an educators product and your educator status cannot be verified, you may keep your product, however, you are not eligible to receive any free ‘Families’ online course coupon codes. 

2.4 We may terminate your licence to use any purchased products if you breach this contract.

3. Payment

3.1 Payment is required in full at the time of purchase.

3.2 All products sold by us are charged in AUD dollars. If you are located in Australia, your GST payment is covered by us, that is, we will cover the 10% GST in the price of the product. If you reside outside Australia, you will pay the price of the product as indicated on the website.

3.3 Upon completion of payment, a confirmation email will be sent to you with instructions on how to access the product.

4. Refund and Guarantee Policy

4.1 Money Back Guarantee: We want you to be satisfied with your purchase. If, within 14 days of your purchase of the online course, you do not believe the course is fit for your purpose, you may request a full refund.

To claim your refund, you must:
• Submit your request in writing to us within 14 days of purchase.
• State the reason why you believe the course is not fit for your purpose.
• Agree to delete any copies of downloaded material from your devices.

4.2 Australian Consumer Law: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

5. Privacy

5.1 By purchasing products from our website, you agree that we will collect and store your personal details for the purpose of processing your order and providing the services purchased. Your details will not be disclosed to third parties except as required by law.

5.2 Credit card transactions are processed securely, and no card details are stored by Sparky and Shady after the completion of a sale.

Any complaint may be made via email through the contact page. We will respond to any complaint within 10 business days of receipt. If you are not satisfied with how we deal with your complaint, you may contact the Australian Competition and Consumer Commission (ACCC) or the Australian Information Commissioner (http://www.oaic.gov.au/).
